Trading Terms

1. Faulty Goods and Repairs

1.1

If any item purchased from us is found to be damaged or faulty upon receipt, we may offer a repair, replacement, or refund where appropriate, in accordance with your statutory rights. If you believe an item is faulty, you must notify us as soon as possible so that we can arrange inspection, repair, replacement, or return of the item(s).

1.2

All repair work carried out by the Company is covered by a guarantee of up to 6 months from the date of completion. Any full retrim work completed by the Company is covered by a 12-month guarantee.

1.3

Where additional repair work is carried out on an item already repaired by the Company and still within the original guarantee period, the remaining balance of the original guarantee will continue to apply. A new guarantee period will not commence unless otherwise agreed in writing.

1.4

Nothing within these terms affects your statutory legal rights.

2. Terms of Payment

2.1

All payments from private customers must be paid in full before goods are released or collected.

2.2

Unless otherwise agreed in writing, payment must be made by the Customer no later than 30 days from the date the goods or items are received or collected.

2.3

All invoices are payable within 30 calendar days from the invoice date unless alternative payment terms have been agreed in writing.

2.4

If payment is not received by the due date, the Company reserves the right to charge statutory late payment interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

2.5

Late payment interest will accrue on the outstanding balance at a rate of 8% per annum above the Bank of England base rate and will be calculated daily from the day following the payment due date until payment is received in full.

2.6

The Company also reserves the right to charge fixed late payment compensation in accordance with the Late Payment of Commercial Debts Regulations 2013. The applicable fees are:

  • £40 for debts up to £999.99

  • £70 for debts between £1,000 and £9,999.99

  • £100 for debts of £10,000 or more

2.7

The Company further reserves the right to recover any reasonable debt recovery costs incurred where such costs exceed the fixed compensation amounts stated above.

3. International Customers

3.1

This section applies to all customers whose permanent residence, business, or vehicle registration is outside the United Kingdom.

3.2

All quotations are provided in Pounds Sterling (GBP) unless otherwise agreed in writing and remain valid for thirty (30) days from the date of issue.

3.3

Any additional work requested after acceptance of a quotation may be subject to additional charges and will only be undertaken following the Customer's approval.

3.4

Unless otherwise agreed in writing, payment for international customers must be made in full and cleared before the vehicle, goods or components are released for collection or shipment.

3.5

Payments must be made in Pounds Sterling (GBP). The Customer is responsible for all bank transfer charges, intermediary bank fees, currency conversion charges and any other payment processing costs.

3.6

RGUpholstery Ltd is registered for Value Added Tax (VAT) in the United Kingdom.

Unless a transaction qualifies for relief or zero-rating under applicable UK VAT legislation, VAT will be charged at the prevailing UK rate regardless of the Customer's country of residence.

Where a Customer believes a transaction qualifies for zero-rating or any other VAT relief, the Customer must notify the Company before work commences and provide any documentation reasonably requested by the Company. The decision to apply any VAT relief remains solely at the Company's discretion in accordance with UK legislation and HM Revenue & Customs guidance.

3.7

The Customer is solely responsible for all customs declarations, import duties, overseas VAT, GST or similar taxes, customs clearance charges, brokerage fees and any other taxes or charges imposed outside the United Kingdom.

3.8

Where requested, the Company may provide commercial invoices or supporting export documentation. The Customer remains responsible for ensuring compliance with all import and export requirements applicable within their jurisdiction.

3.9

Where the Customer or their appointed carrier collects a vehicle, goods or components for export from the United Kingdom, responsibility for transportation, insurance, customs compliance and export procedures passes to the Customer immediately upon collection.

3.10

Whilst every reasonable care will be taken whilst a vehicle or components are in the Company's possession, the Company accepts no liability for loss or damage occurring after collection by the Customer or their appointed carrier.

3.11

Vehicles, goods or components not collected within seven (7) days of notification that the work has been completed may be subject to reasonable storage charges unless otherwise agreed in writing.

3.12

Where a warranty claim relates to goods or services supplied to an international customer, the Company may require the relevant item or vehicle to be returned to its premises in the United Kingdom for inspection and repair. Unless otherwise agreed in writing, all transport, customs and associated costs shall be the responsibility of the Customer.

3.13

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Any dispute arising from work undertaken by RGUpholstery Ltd shall be subject to the exclusive jurisdiction of the courts of England and Wales.
